1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the Triune AI Finance Assistant (the “Service”) operated by Triune Capital Group (“Company,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Triune AI Finance Assistant is an AI-powered financial planning tool that helps small business owners generate financial analysis, SEO strategies, email sequences, content calendars, and other financial reports. The Service uses Anthropic's Claude AI model to generate content based on your inputs.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

4. Account Registration

To access the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscription and Payment

Plans and Pricing

The Service offers paid subscription plans as described on our pricing page. Prices are subject to change with reasonable notice.

Free Trial

New subscribers may be eligible for a 14-day free trial. You must provide valid payment information to start a trial. If you do not cancel before the trial period ends, your subscription will automatically begin and your payment method will be charged.

Billing

Subscriptions are billed monthly on the anniversary of your subscription start date. All payments are processed securely through Stripe. You authorize us to charge your selected payment method for all applicable fees.

Cancellation

You may cancel your subscription at any time through your account dashboard. Upon cancellation, your subscription will remain active until the end of your current billing period. No refunds will be issued for partial billing periods.

6. AI-Generated Content

Ownership

You retain ownership of the inputs you provide to the Service. Subject to these Terms, you own the AI-generated content created through your use of the Service. However, similar or identical content may be generated for other users based on similar inputs.

Accuracy and Limitations

AI-generated content may contain errors, inaccuracies, or outdated information. You are solely responsible for reviewing, editing, and verifying all content before publishing or using it in your business. The Company does not guarantee the accuracy, completeness, or suitability of any AI-generated content.

No Guaranteed Results

The Service provides marketing suggestions and content generation tools. We do not guarantee any specific business results, including but not limited to increases in traffic, leads, revenue, or return on investment. Any projections, estimates, or forecasts provided by the AI are for informational purposes only and should not be relied upon as guarantees.

7. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Generate spam, phishing content, or deceptive financial reports
  • Attempt to circumvent any usage limits or security measures
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Share your account credentials with unauthorized users
  • Use the Service to compete directly with us or create a competing product

8. Intellectual Property

The Service, including its design, features, code, and branding, is owned by Triune Capital Group and is protected by intellectual property laws. These Terms do not grant you any right to use the Company's trademarks, logos, or other brand elements.

9. Third-Party Services

The Service integrates with third-party services including Anthropic (AI), Stripe (payments), and Supabase (authentication and data). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of these third-party services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Indemnification

You agree to indemnify and hold harmless Triune Capital Group and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination will remain in effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Arkansas.

15. Changes to Terms

We may revise these Terms at any time by posting the updated Terms on this page. Material changes will be communicated via email or a prominent notice within the Service. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
